Preliminary Information Form for Distance Sales Agreement

ARTICLE 3 – Subject

The purpose of this Preliminary Information Form (“Form”) is to inform the Buyer (“BUYER”) in accordance with Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts published in the Official Gazette dated November 27, 2014, No. 29188, regarding the sale and delivery of the products (“Products”) specified below, including their nature and sales price.

ARTICLE 4 – Basic Characteristics of the Products and Payment Information

4.1. The description, unit price, quantity, and payment terms of the Products are as stated in this Preliminary Information Form and have been approved by the Buyer.

4.2. The shipping or delivery fee shall be paid by the Buyer, unless the Seller provides otherwise.

ARTICLE 5 – Validity Period of Commitments

The prices indicated in Article 4.1 represent the sales prices. Published prices and offers remain valid until updated or changed. Prices announced for a specific period are valid until the end of that period.

ARTICLE 6 – General Provisions

6.1. The Buyer declares that they have read and acknowledged all preliminary information related to the essential characteristics of the product, total sales price including taxes, payment method, delivery details, and the Seller’s full trade name, address, and contact information, and has provided the necessary electronic confirmation.

6.2. The Seller shall not be liable for any direct or indirect damages arising from the use of the website, mobile application, or any associated data or programs, including but not limited to interruption of operations, communication failures, data loss, viruses, or unauthorized access.

6.3. The Seller reserves the right to change, reorganize, or suspend any services, products, terms of use, and information provided on the website and/or mobile application without prior notice. Changes take effect upon publication.

6.4. The website and mobile application may contain links or references to third-party sites not under the Seller’s control. The Seller is not responsible for the content of these sites or other links contained within them.

6.5. The Seller owns or is licensed to use all intellectual and industrial property rights of the website and mobile application, including but not limited to its design, content, logos, images, domain name, software, and business models. No material from the site or application may be copied, modified, republished, or distributed without written consent.

6.6. The Buyer’s personal data may only be disclosed to official authorities when required by applicable mandatory legal regulations.

6.7. Unless otherwise stated, the products shall be delivered within 30 days from the date of order confirmation, to the Buyer’s address or designated recipient, via the Seller’s contracted courier (currently UPS Cargo & PTT Cargo). Shipping fees will be detailed on the Buyer’s invoice or charged as “Delivery Fee.”

6.8. For custom-made products, production and delivery dates may vary; the Seller will inform the Buyer accordingly. For imported goods, potential delays caused by customs or logistics shall extend the delivery period.

6.9. If the product is to be delivered to another recipient who refuses delivery, the Seller shall not be held responsible.

6.10. The Seller is not responsible for damages or delays caused by the shipping company during transport. The Buyer must inspect the products upon delivery and notify the Seller of any defects immediately.

6.11. The Seller is responsible for delivering products complete, intact, and in accordance with the order specifications, including any warranty certificates and user manuals.

6.12. If the ordered product becomes unavailable, the Seller may provide the Buyer with an alternative of equal quality and value, or refund the amount paid.

6.13. In case of unauthorized payment by third parties, the Buyer must return the delivered product within three (3) days; otherwise, the Seller reserves all legal rights.

6.14. If the ordered product is out of stock and no equivalent is available, the Seller reserves the right to refund the payment.

6.15. In cases of force majeure or extraordinary events (e.g., adverse weather, transport restrictions), delivery may be delayed. If the Buyer cancels the order, payment will be refunded within 14 days using the same payment method.
For custom-made furniture, lighting, or similar items, production or delivery delays may occur. Such orders cannot be canceled or refunded.

6.16. Refunds for canceled credit card transactions are processed within 14 days; bank posting times may vary (2–3 weeks).

6.17. The Seller reserves the right to cancel wholesale or excessive quantity orders exceeding three (3) units per product.

6.18. The Seller may request verification documents (such as ID and credit card proof) in case of failed or suspicious payment attempts. If not provided, the Seller may cancel the order.

6.19. If a pricing error occurs that is clearly disproportionate to the market price, the Seller reserves the right to cancel such orders.

6.20. In accordance with the Banking Regulation and Supervision Agency’s decision published on 10/03/2007 in the Official Gazette No. 26458, “Cosmetic Products” are not eligible for installment payments.

ARTICLE 7 – Right of Withdrawal

7.1. Except for custom-made products, the Buyer has the right to withdraw from the contract within 14 (fourteen) days of delivery without providing justification or incurring any penalty.

Determination of this period:
a) For goods delivered separately under one order, from the date of receipt of the last item;
b) For goods consisting of multiple parts, from the date of receipt of the final part;
c) For regular deliveries, from the date of the first delivery.

7.2. The Buyer may notify the Seller of withdrawal by registered mail, e-mail, or telephone. The Seller will contact the Buyer to arrange product collection, or the Buyer must return the goods within ten (10) days to the address specified in Article 1.

7.3. For returns to be valid, the Buyer must complete and sign the return section of the invoice and send it with the product.

7.4. Returned products must be undamaged, with original packaging and accessories intact.

7.5. The Seller must refund all payments received within 14 (fourteen) days of receiving the withdrawal notice.

7.6. The cost of returning products due to withdrawal shall be covered by the Seller if returned via the Seller’s contracted courier (UPS Cargo). If the Buyer chooses another courier, shipping costs are borne by the Buyer.

7.7. If the product’s value decreases or becomes impossible to return due to the Buyer’s fault, the Buyer shall compensate the Seller accordingly. Normal wear and tear from reasonable use does not count as depreciation.

ARTICLE 8 – Products Excluded from the Right of Withdrawal

The Buyer may not exercise the right of withdrawal for the following:

a) Custom-made products prepared according to the Buyer’s specifications (size, color, material, etc.), except in cases of defects.
b) Goods prepared to meet the Buyer’s personal needs.
c) Goods liable to deteriorate or expire rapidly.
d) Goods unsealed after delivery that are unsuitable for return due to health or hygiene reasons.
e) Goods that are mixed with others and cannot be separated due to their nature.
f) Books, digital content, or computer consumables whose packaging has been unsealed.
g) Newspapers or magazines outside a subscription agreement.
h) Services performed instantly or digital goods delivered immediately.
i) Services that have begun with the Buyer’s consent before the withdrawal period ends.

ARTICLE 9 – Complaints and Resolution

The Buyer may communicate any suggestions or complaints regarding the product or service via the Seller’s contact information provided in Article 1. The Seller aims to resolve such issues within the legal framework.

ARTICLE 10 – Jurisdiction

In the event of disputes, the Buyer may apply to the Consumer Arbitration Committee or Consumer Court located in their place of residence or where the purchase was made, within the monetary limits set annually by the Ministry of Trade.

ARTICLE 12 – Other Provisions

The Buyer declares that they have read, understood, and electronically accepted this Preliminary Information Form and the Distance Sales Agreement.
